Niemand mag worden Gediscrimineerd door enig Openbaar Gezag
Unfortunately, in the Social Debate of recent weeks, more and more Emphasis has been placed on the Distinction between People who have been Vaccinated and those who have Not been Vaccinated. As a Lawyer, but especially as a Human Being, I stand for Article 1 Protocol, N° 12 to the Convention on Human Rights and Fundamental Freedoms (Protocol of 4 November 2000, Tractatenblad, 2001, N° 18, entered into Force for the Netherlands on 1 April 2005). This Article contains a General Prohibition of Discrimination. I quote Paragraph 1. ‘The Enjoyment of any Right laid down in the Law must be Ensured without Discrimination on any Grounds, such as Gender, Race, Colour, Language, Religion, Political or Other Opinion, National or Social Origin, Membership of a National Minority, Property, Birth or other Status‘. Whether or Not they have been Vaccinated is undoubtedly covered by ‘Different Status‘. Especially for the Outgoing Mark Rutte Cabinet, I also quote the Second Paragraph. ‘No One should be Discriminated against by any Public Authority on one of the Grounds Mentioned in Paragraph 1 in particular‘.
